TRADE MARKS:
A trademark is a unique sign that individualizes the goods, services or business name of a given enterprise and distinguishes them from others. It can be in the form of name, words, designs, letters, numerals or packaging, slogans, devices, symbols, etc.
The Trademark registration Service includes all the necessary formalities for filing the application for registration till the granting of the mark (Final certificate), official fees, professional fees as well as all taxes.
The customer is provided Trade Mark Number in 2 days and an initial acknowledgment certificate issued by the trade mark registration authority with in 30 days of filing of the Case.
However, in the absence of objections and oppositions, the total time of finalization of a Trademark Case in Pakistan takes 2 years. But our professional experience has demonstrated that the usual time for the registration till the delivery of Final trademark Certificate can be of 3 years as the timeframe for registration are estimated and may considerably vary if objections and/or oppositions are presented, or other unavoidable events or circumstances occur during the trademark registration process. COPYRIGHT:
Copyright is a form of protection provided to the authors of “original works of authorship,” including literary, dramatic, musical, artistic, and certain other intellectual works. This protection is available to both published and unpublished works.
Copyrightable works include the following categories:

These categories should be viewed broadly. For example, computer programs and most “compilations” may be registered as “literary works”.
The owner of copyrights has the exclusive right to do and to authorize others to do the following:

To reproduce the work in copies or phonorecords; |

To prepare derivative works based upon the work; |
3. |
To distribute copies or phonorecords of the work to the public by sale or other transfer of ownership, or by rental, lease, or lending; |
4. |
To perform the work publicly, in the case of literary, musical, dramatic, and choreographic works, pantomimes, and motion pictures and other audiovisual works; |
5. |
To display the work publicly, in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work; and |
6. |
In the case of sound recordings, to perform the work publicly by means of a digital audio transmission. |
It is illegal for anyone to violate any of the rights provided by the copyrights law to the owner of copyrights. These rights, however, are not unlimited in scope; the copyrights law establishes limitations on these rights. In some cases, these limitations are specified exemptions from copyrights liability. One major limitation is of “fair use,” In other instances, the limitation takes the form of a “compulsory license” under which certain limited uses of copyrighted works are permitted upon payment of specified royalties and compliance with statutory conditions.
